EYE WITNESSES SAW NO BRAKE LIGHTS AT ANY POINT. AUTOPSY CONCLUDED THAT THE DRIVER DIED FROM TRAUMA CAUSED BY IMPACT WITH THE TREE. THE VEHICLE WAS A 07 PRIUS. *TR

I HAVE OWNED TWO 2007 TOYOTA PRIUS. BOTH HAVE BEEN TOTALED DUE TO WHAT I BELIEVE IS A FAILURE OF THE HYBRID DRIVETRAIN TO DISENGAGE DURING EMERGENCY BRAKING. FIRST 2007 PRIUS, PURCHASED NEW IN 2007. ON DEC 9, 2009, TO AVOID A COLLISION, I FULLY PRESSED THE BRAKES WITH FULL FORCE HOWEVER THE PRIUS CONTINUED TO PROPEL FORWARD. I SHOULD EASILY HAVE BEEN ABLE TO STOP THE VEHICLE IN TIME. AS IT CONTINUED TO PROPEL FORWARD, I COLLIDED WITH THE OTHER CAR. THE SPEED AT THE MOMENT OF IMPACT WAS APPROX 25 MPH. NO AIRBAGS WERE DEPLOYED. THE VEHICLE WAS DEEMED A TOTAL LOSS DUE TO THE EXTENSIVE COST OF REPAIRING THE HYBRID SYSTEM. I HAVE THE PHOTOGRAPHS OF THE ACCIDENT AND THE POLICE REPORT. SECOND TOYOTA PRIUS: I PURCHASED AN EXACT REPLACEMENT USED 2007 PRIUS IN DEC 2009. ON OCTOBER 17, 2015, A CAR STOPPED ABRUPTLY IN FRONT OF MY WIFE WHO WAS DRIVING AT APPROX 40 MPH. SHE REPORTED PRESSING ON THE BRAKES WITH FULL FORCE BUT THAT THE PRIUS CONTINUED TO PROPEL FORWARD. SHE HIT CAR IN FRONT THEN SWERVED TO THE RIGHT AS THE PRIUS CONTINUED TO PROPEL FORWARD. SHE STEERED TO THE LEFT INTO THE CENTER MEDIAN AND THE PRIUS STOPPED. THE CAR THEN CAUGHT ON FIRE. NO AIRBAGS WERE DEPLOYED. I HAVE THE PHOTOGRAPHS OF THE VEHICLE AND THE POLICE REPORT. I CONTACTED TOYOTA IN NOV 2015. AN INVESTIGATION WAS OPENED. A TOYOTA 'FIELD TECHNICAL SPECIALIST' INSPECTED THE VEHICLE. I SIGNED AN 'EDR CONSENT FORM' FOR TOYOTA TO READ ANY DATA FROM THE VEHICLE. HOWEVER DUE TO THE FIRE, THEY WERE NOT ABLE TO READ ANY DATA. ON JANUARY 26, 2016 I RECEIVED A LETTER FROM A LEGAL CLAIMS ADMINISTRATOR AT TOYOTA MOTOR SALES, USA, INC., STATING 'OUR INSPECTION WAS UNABLE TO CONFIRM ANY EVIDENCE OF A MANUFACTURING OR DESIGN DEFECT IN YOUR VEHICLE'. I CONTINUE TO OWN THE VEHICLE AND HAVE IT IN MY POSSESSION AT THIS TIME.

The lights spontaneously turned off while driving on a cloudy night on an unlit section of interstate. While slowing the car down, it went onto gravel, semi-circled around and flipped over onto the lower median. No air bag deployed. No protection from shoulder seat belt. Head hit steering wheel, and I briefly lost consciousness. Tests showed skull and cervical fractures. The car was "totaled." I was planning a move. Now I consider myself to be lucky to be alive. I am rewriting because of previous a NHTSA computer malfunction changing a serious injury to "NO" injury on the questionnaire.

The contact owned a 2007 Toyota Prius. The contact stated while driving approximately 30-35 MPH, the vehicle in front of her slammed on the brakes, causing her vehicle to crash into its rear end. The air bags failed to deploy. There were no warning lights illuminated. The contact sustained a severe whiplash. The contact was able to exit the vehicle through the front passenger side window. The contact stated that her son transported her to the hospital, where she was informed that she had sustained a concussion and neck abrasion injuries. A police report was filed. The vehicle was towed to a collision shop, where it was totaled. The dealer was not notified of the failure. The manufacturer was notified of the failure but did not provide any assistance. The failure mileage was approximately a 180,000. The VIN was not not available.

THE PARAMEDICS TRANSPORTED THE CONTACT TO A LOCAL HOSPITAL WHERE SHE SUFFERED FROM INJURIES TO HER CHEST AND BACK. A POLICE REPORT WAS FILED. THE CONTACT STATED THAT PRIOR TO THE FAILURE, THE VEHICLE WAS TAKEN TO SANSONE TOYOTA (90-100 US-1, AVENEL, NJ 07001, (732) 815-0500) WHERE THE BRAKES WERE SERVICED TWICE. THE VEHICLE WAS TOWED TO A LOCAL TOW YARD AND DEEMED DESTROYED. THE MANUFACTURER WAS NOTIFIED OF THE FAILURE AND SENT AN INVESTIGATOR TO CHECK THE VEHICLE'S BLACK BOX. THE CONTACT WAS INFORMED THAT THERE WERE NO FAILURES FOUND ON THE BLACK BOX AT THE TIME OF THE CRASH. THE CAUSE OF THE FAILURE WAS NOT DETERMINED. THE FAILURE MILEAGE WAS 58,000. THE VIN WAS UNKNOWN.

I WAS GOING APPROXIMATELY 25-30 MPH AT THE TIME OF IMPACT, AS I DID NOT HAVE THE OPPORTUNITY TO BRAKE EFFECTIVELY. MY CAR WAS TOTALED IN THE COLLISION. I SUFFERED BRUISING TO MY STERNUM AND KNEES AS WELL AS SEVERE BRUISING ON MY KNEES AND HIP. MY AIRBAGS DID NOT DEPLOY, AND THIS WAS REMARKED UPON BY THE FIREFIGHTERS, PARAMEDICS AND POLICE THAT RESPONDED TO THE ACCIDENT. I AM CONCERNED BECAUSE THIS IS THE SECOND TOYOTA I HAVE BEEN IN AN ACCIDENT WITH IN WHICH THE AIRBAGS DID NOT DEPLOY. THE LAST ACCIDENT WAS IN A 1996 TOYOTA COROLLA IN A HIGH SPEED ACCIDENT ON THE FREEWAY IN WHICH MY CAR HAD LOCKED ONTO THE CAR THAT HAD HIT ME AND WE SPUN OUT ON THE FREEWAY. AGAIN MY CAR WAS TOTALED AND NO AIRBAG DEPLOYED. AFTER DOING RESEARCH ON THE INTERNET, IT WOULD SEEM THIS IS A CONTINUING PROBLEM WITH TOYOTAS, WHICH SHOULD BE REMEDIED AS A MATTER OF PUBLIC SAFETY.

ONE OF THE INJURIES SUSTAINED WAS A FRACTURE TO MY RIGHT FIFTH METACARPAL BONE CAUSED BY PROJECTILE SHRAPNEL, MOST LIKELY FROM THE DEPLOYED AIR BAG. THE SHRAPNEL WAS 2MM X 10MM, BLACK AND APPEARED TO BE PLASTIC PER THE OPERATIVE REPORT BY THE SURGEON WHO REMOVED IT. FOR SUCH A LIGHT PIECE OF PLASTIC TO CAUSE THIS EXTENSIVE A COMMINUTED FRACTURE, THE PROJECTILE MUST HAVE BEEN TRAVELING AT A VERY HIGH VELOCITY MOST LIKELY CAUSED BY THE AIR BAG'S EXPLOSIVE FOR [XXX] 'INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6).'

IT WENT OVER A 1 FT CONCRETE CURB LIMITER INTO THE STREET AND AFTER A 180 DEGREE LOOP IN REVERSE I FINALLY HIT THE E-BRAKE HARD WHILE AT THE SAME TIME I RAN OVER A PEDESTRIAN TRAFFIC LIGHT AND HIT A TREE WITH THE REAR PASSENGER SIDE TO A FULL STOP. AIR BAGS DID NOT DEPLOY. DURING ALL THIS PERIOD OF PROBABLY LESS THAN 10 SECONDS THE FOOT BRAKE WAS NOT RESPONDING ANY MORE. AFTER IMPACT THE ENGINE DID NOT START ANYMORE AND THE CAR WAS TOWED FROM THE SCENE.

THE ACCIDENT IS COMPLICATED BECAUSE THE DRIVER CAN'T REMEMBER MUCH OF WHAT HAPPENED BEYOND SHE WAS PULLING OVER TO THE RIGHT SHOULDER TO CHANGE DRIVERS OR REST, BUT THE FRONT SEAT PASSENGER WAS ABRUPTLY WOKEN UP FROM A SCHEDULED NAP BY WHAT SEEMED TO HIM LIKE A POTHOLE OR PERHAPS AN ABRUPT EDGE TO THE ROAD FOLLOWED QUICKLY BY A ROUGH RIDE. WHEN HE OPENED HIS EYES HE SAW THE CAR ON THE WILD CLUMPS OF GRASS LIKE VEGETATION ON THE OUTSIDE OF THE REFLECTOR STAKE LINE AND AN ODD SHOULDER THAT WAS ONLY PARTIALLY CEMENT OR PAVEMENT WITH A SUBSTANTIAL GAP BETWEEN THE SIDE REFLECTORS AND HARD SURFACE. THIS WAS SEMI-CONFIRMED WHEN REENTERING WYOMING WITH HIS OLDEST SON DRIVING AND SEEING SIMILAR PARTIAL SHOULDERS, BUT THE SON WAS UNWILLING TO DRIVE FARTHER TO THE ACCIDENT SCENE. THE PASSENGER'S BELIEVES THE TRACTION CONTROL ENGAGED AND CAUSED THE CAR TO GO OFF THE SHOULDER, IN PART BECAUSE OF A SIMILAR PROBLEM WITH A GEO PRIUS LSI ABS BRAKE SYSTEM ON ICE THAT CAUSED WHAT WOULD HAVE NOT OTHERWISE HAVE BEEN SIGNIFICANT VEHICLE DAMAGE. THE ALTERNATIVE EXPLANATION IS A DEFECT OR DEBRIS ON THE SHOULDER ITSELF. THE DRIVER TRIED TO GET BACK ON THE HIGHWAY INSTEAD OF FOLLOWING THE SLIGHT CONTOUR DOWN OF THE SHOULDER OUTSIDE RIGHT OF WAY AND THAT OR TRACTION CONTROL MAY HAVE CAUSED THE CAR TO LEAVE THE PARTIAL SHOULDER. THE VEHICLE WAS LAST SEEN AT HP TOWING IN EVANSTON, WYOMING. IT WAS TOTALED AND TITLE WILL BE TRANSFERRED TO ALLSTATE INSURANCE. THE SEAT BELTS IN THIS CAR ARE TOO THIN AND TEND TO TWIST UP PREVENTING CONSISTENT SUPPORT. THE PASSENGER PROTECTIVE CAGE IN THE TOYOTA PRIUS DID AN IMPRESSIVE JOB OF PROTECTING THE OCCUPANTS BUT A PLASTIC LAYER WOULD HAVE PREVENTED INJURIES AND CONTENTS LOSS. *TR

I SUSTAINED CONSIDERABLE CONTUSIONS TO MY RIBS, ELBOW, KNEES, AND ANKLES. I HAVE A TORN TENDON IN MY RIGHT ANKLE, AND WHIPLASH SEVERE ENOUGH TO REQUIRE PHYSICAL THERAPY.
