The contact owns a 2007 Toyota Tundra. The contact initially received a recall notice for NHTSA Campaign Number: 09V388000(Vehicle Speed Control); the vehicle was taken to the dealer and the recall was serviced. Recently, the contact stated that as his wife was exiting their driveway, the vehicle independently accelerated without warning. The contact's wife turned the vehicle into her yard where she hit four trees and then crashed into a big tree which stopped the vehicle. The air bags deployed once she crashed into the bigger tree. The contact's wife was thrown to the right and hit her head on the rearview mirror. His wife was taken to the hospital by ambulance where she was treated for the head wound and back pain. She later sought treatment from an orthopedic doctor where they discovered three compressed fractures to her vertebrae(T1, T2, and T3). A police report was filed. The contact did his own investigation into the accident and discovered that black box had recorded that the vehicle's speed was 42.3 MPH at the time of the failure. Both the dealer and the manufacturer were notified of the failure but both offered no assistance. The vehicle remained in the contact's possession. The vehicle had yet to be repaired. The failure mileage was approximately 164,000.

THE SUV STARTED COMING INTO MY LANE I PUT MY BRAKES ON SUDDENLY TO HAVE THE IMPACT BE AT A SLOWER SPEED BUT AS I PUSHED DOWN ON THEM THEY FELL TO THE FLOOR SO I WAS TAKEN OUT AT 65 MILES AN HOUR. THE MAN WAS A RN NURSE WHO PULLED A GRAVEYARD SHIFT AND WAS DOSING OFF. HE ADMITTED IT WAS HIS FAULT AND THE COP SAID NO REPORT WOULD BE MADE BECAUSE THE LAW IS NO AMBULANCES NO REPORT. I DEMANDED A REPORT AND HE SAID THAT IS CALIFORNIA'S NEW LAW. TOLD TOYOTA ABOUT THE BRAKES FALLING TO THE FLOOR. THERE ANSWER IS " THAT IT WAS NORMAL". THEY INSPECTED THE ENGINE FOR DAMAGE. I WAS INVOLVED IN A CAR ACCIDENT WHERE A FULL SIZE DODGE RAM PICK UP HIT ME ON THE DRIVER'S SIDE OF MY TOYOTA. IT HIT ME ON THE FRONT FENDER AND SLIGHTLY ON THE FRONT OF THE DOOR. WHEN I WAS HIT ON THE SIDE MY SIDE AIR BAGS DID NOT DEPLOY. WHEN I WAS HIT MY HEAD IT THE DRIVER'S SIDE WINDOW AND KNOCKED ME OUT. WHICH IN TURN MY TRUCK WAS STILL IN MOTION WHILE I WAS KNOCKED OUT AND I PROCEEDED TO GO THROUGH A LADIES YARD AND CAME TO A STOP ONCE IT HIT HER SHED HEAD ON, WHICH THOSE AIR BAGS DID NOT DEPLOY EITHER. THE VEHICLE WAS TAKEN BACK TO THE DEALER AFTER THE RECALL WORK WAS PERFORMED AND THEY COULD NOT LOCATE THE FAILURE. THE APPROXIMATE FAILURE AND CURRENT MILEAGE WERE 59,500.

TO HER DEMISE, AFTER PUSHING THE BRAKE PEDAL TO STOP, THE VEHICLE, A 2007 TOYOTA TUNDRA CREW CAB DID NOT STOP, INSTEAD, AUTOMATICALLY INCREASED SPEED TO OVER 20 MPH. SHE WAS FORCED TO MAKE A LEFT TURN ON 71ST STREET TO AVOID AN ACCIDENT OR FROM CRASHING UNTIL A 1990 TO 1994 GREEN FORD EXPLORER GOING AT SPEEDS WELL OVER 50 MPH ON NW 5TH COURT COMING FROM THE EAST TO WEST, RAMMED/CRASHED INTO THE FRONT PASSENGER SIDE OF THE TOYOTA TUNDRA AS MY WIFE WAS MAKING THE LEFT TRYING TO EVADE TRAFFIC AND MAKE THE TUNDRA STOP. HIS FORD EXPLORER COMPLETELY TOTALED THE TUNDRA. I THEN ARRIVED AT THE SCENE TO FIND MY WIFE WITH SERIOUS INJURIES AND TOOK HER TO THE ER. I WAS SO GLAD TO SEE SHE WAS ALIVE AND WAS ABLE TO CAREFULLY TRANSPORT HER TO THE HOSPITAL. IF SOMEONE WOULD HAVE CRASHED INTO THE DRIVER SIDE OR A FRONT END COLLISION OCCURRED, MY WIFE WOULD DEFINITELY HAVE NOT SURVIVED. I FEEL, GOD WAS ON HER SIDE THAT DAY AND GAVE HER A SECOND CHANCE AT LIFE. THE MAN IN THE GREEN FORD EXPLORER COULD HAVE SLOWED DOWN AND STOPPED, BUT DID NOT. THE CONTACT STATED NEITHER THE DEALER NOR THE MANUFACTURER WOULD ACKNOWLEDGE THE FAILURE POTENTIALLY COULD HAVE BEEN CAUSED BY A STUCK ACCELERATOR PEDAL. THE FAILURE MILEAGE WAS 44,129 AND THE CURRENT MILEAGE WAS 44,537.

2007 TOYOTA TUNDRA. CONSUMER STATES CRUISE CONTROL DOES ENGAGE AND THEN WILL NOT DISENGAGE BRAKES. *TGW THE CONSUMER STATED THE BRAKES WOULD NOT HOLD AT STOP SIGNS AND THE VEHICLE WOULD MOVE FORWARD. THE VEHICLE HAD ELECTRICAL SHORTS IN THE WIRING SUCH AS; THE HEADLIGHTS, CLOCK, CIGARETTE LIGHTER, ALARM AND DOOR LOCKS. THE SEAT BELTS WOULD NOT ALWAYS LATCH. THE WINDSHIELD WIPERS WOULD NOT ACTIVATE, THERE WAS A SEVERE SHAKE COMING FROM THE FRONT OF THE VEHICLE AS WELL AS WHEN THE BRAKES WERE APPLIED. THERE WAS A NOISE COMING FROM THE 4-WHEEL DRIVE, THE STEERING WOULD ACT ERRATIC AND THE ACCELERATOR PEDAL BECAME STUCK WHICH CAUSED THE CONSUMER TO HAVE AN ACCIDENT WHILE BACKING OUT OF HIS DRIVEWAY.. *JB
