AIR BAG FAILURE--ON WEDNESDAY JULY 13 2016 THE VEHICLE (2009 DODGE RAM 1500) WAS INVOLVED IN A FRONT END COLLISION WHILE TRAVELING ON A CITY OWNED ROAD. THE DRIVER WHO WAS THE ONLY PERSON IN THE VEHICLE LOST CONTROL OF THE VEHICLE WHEN TAKING A SHARP RIGHT TURN ON A DIRT ROAD IN THE DARK. AS A RESULT THE VEHICLE CRASHED INTO A DITCH, COMPLETELY SMASHING IN THE FRONT END AND DAMAGED MOST OF THE REST OF THE TRUCK AS WELL. UPON IMPACT THE DRIVER'S AIR BAG DID NOT DEPLOY. THE DRIVER SUSTAINED INJURIES TO HIS ENTIRE UPPER BODY AS WELL AS SUFFERING FROM A CONCUSSION UPON IMPACT BECAUSE OF THE AIR BAG MALFUNCTION. HE REQUIRED EMERGENCY MEDICAL ATTENTION AND WAS TRANSPORTED TO THE HOSPITAL BY AMBULANCE. AT APPROX 1PM ON JAN 22ND I WAS DRIVING NORTH ALONG A SECONDARY ROAD IN MY 2009 DODGE RAM 1500. I WAS TRAVELING AT APPROX 40 MPH WITH MY SEATBELT ON WHEN I BEGAN TO HEAR A WHISTLING NOISE FROM THE TRUCK. AS I SLOWED TO FIGURE OUT WHAT IT WAS, A LOUD BANG WAS HEARD AND THE TRUCK SPUN VIOLENTLY IN A COUNTERCLOCKWISE MOTION. AS IT DID, THE TRUCK WENT AIRBORNE AND CROSSED OVER THE SOUTHBOUND SIDE OF THE HIGHWAY. IT CHROMED OFF THE BOTTOM OF SOME LOW HANGING TREE BRANCHES AND CAME TO A REST IN THE DITCH TO THE RIGHT OF THE SOUTHBOUND SIDE OF THE ROAD. INITIALLY I DID NOT FEEL ANY PAIN BUT CALLED FOR A TOW TRUCK. SHORTLY AFTERWARDS I BEGAN TO HAVE SOME SIGNIFICANT PAIN IN MY LEFT SHOULDER/NECK AND MY RIGHT RIBCAGE AREA. FIRE AND EMS WERE DISPATCHED AND ARRIVED APPROX 5-10 MINUTES LATER. I WAS TAKEN TO A LOCAL ER, EVALUATED AND RELEASED WITH CRACKED CARTILAGE IN MY LOWER RIGHT RIBCAGE AREA. THE TRUCK WAS TOWED TO A LOCAL DODGE DEALER FOR EVALUATION. I WAS LATER INFORMED THAT THE REAR PINION NUT HAD COME OFF CAUSING THE GEAR TO COME INTO CONTACT WITH THE DRIVESHAFT, LOCKING UP THE LEFT REAR WHEEL. THERE WAS AN APPARENT RECALL FOR SIMILAR TRUCKS FROM JULY-SEPT 2009, HOWEVER MY TRUCK WAS PURCHASED IN MARCH 2009. SINCE THE ACCIDENT DODGE HAS RE-ISSUED THE RECALL TO INCLUDE MY TRUCK. I AM WRITING THIS COMPLAINT TO MAKE SURE THAT MY TRUCK IS INCLUDED IN WHATEVER ANALYSIS IS DONE AS A RESULT OF THIS DEFECT. *TR

ALL AIRBAGS IN DODGE RAM FAILED TO DEPLOY AND DRIVER SEATBELT FAILED TO RETRACT/RESPOND RESULTING IN MY HEAD/NECK/SPINAL INJURY. I HAVE WRITTEN DODGE-CHRYSLER, THEY SAY THEY SENT SOMEONE TO INSPECT TRUCK AND SAY THEY ARE NOT RESPONSIBLE FOR THE AIRBAG AND SEATBELT NOT WORKING. DODGE/CHRYSLER ALSO WRITE THE AIRBAG/SEATBELT WAS NOT SUPPOSE TO WORK DUE TO THE SPEED LIMIT (40MPH) DRIVEN AND DUE TO MORE OF A SIDE IMPACT THAN FRONTAL. MOMENTS LATER, 6 MINUTES AT 10:27AM JUNE 9, 2017 THE VEHICLE ROLLS BACKWARDS FROM A STATIONARY POSITION AND STRUCK THE BRICK MAILBOX AT THE END OF THE DRIVEWAY CAUSING UNREPAIRABLE DAMAGE TO THE MAILBOX. THE VEHICLE SUSTAINED DAMAGE TO THE TAILGATE BUMPER AND UNDERCARRIAGE. THE NEIGHBOR ACROSS THE STREET WAS OUTSIDE DURING THE INCIDENT AND WITNESSED THE EVENT AND NOTIFIED ME. THE HOME SECURITY CAMERA CAPTURED THE ABOVE DESCRIBED OF EVENTS. AFTER NOTIFYING FIAT CHRYSLER AUTOMOBILES I LEARNED OF A SAFETY RECALL NHTSA RECALL # 17V-821 THE BRAKE TRANSMISSION SHIFT INTERLOCK. THIS SAFETY RECALL MAY RESULT IN THE FOLLOWING: THE TRANSMISSION MAY BE SHIFTED OF THE PARK POSITION WITHOUT A KEY IN THE IGNITION OR A BRAKE PEDAL APPLICATION. THIS INCREASES THE POTENTIAL FOR AN UNINTENDED VEHICLE ROLLAWAY THAT MAY RESULT IN A VEHICLE CRASH OR INJURY WITHOUT PRIOR WARNING. THIS IS WHAT EXACTLY HAPPENED. THE FIAT CHRYSLER AUTOMOBILES INVESTIGATIONS STATED THEY WERE SORRY AND NOT RESPONSIBLE. THIS IS ABSOLUTELY ABSURD. THE VEHICLE WAS PARKED IN MY DRIVE WAY. I WAS IN THE HOUSE WITH THE KEYS IN MY POCKET. I INSTRUCTED MY CHILDREN TO GET IN THE TRUCK. AS THEY CLIMBED IN, ONE CHILD LOST HER BALANCE AND HIT THE GEAR SHIFT. THE GEAR SHIFT INTERLOCK FAILED, ALLOWING THE VEHICLE TO CHANGE GEARS FROM PARK TO NEUTRAL. THE TRUCK THEN PROCEEDED TO ROLL DOWN MY DRIVEWAY, WITH TWO OF MY KIDS IN THE CAB, AND MY THIRD CHILD HANGING ON THE DOOR BEING DRUG ACROSS THE GROUND. FORTUNATELY, NO ONE WAS INJURED, BUT MY TRUCK PLOWED THROUGH MY DITCH, DESTROYED MY MAILBOX CAUSING $7,800 DAMAGE TO THE TRUCK. I CONTACTED CHRYSLER, WHO PERFORMED A SPECIAL INVESTIGATION. HOWEVER, EVEN THOUGH THEY CONCLUDED THE GEAR SHIFT INTERLOCK DID INDEED FAIL, THEY REFUSED RESPONSIBILITY STATING THAT "MAINTENANCE AND REPAIRS ARE THE RESPONSIBILITY OF THE OWNER." I DID NOT KNOW THAT THE SHIFT INTERLOCK WAS FAILED. IN FACT, THE ENGINEER THAT DID THE INVESTIGATION STATED THAT IT EXHIBITED INTERMITTENT FAILURE. SO THERE WAS NO WAY FOR ME TO KNOW IT WAS FAILED UNTIL I EXPERIENCED A FAILURE. AFTER MY TRUCK ROLLED DOWN THE DRIVEWAY, I REALIZED SOMETHING HAD FAILED. FURTHERMORE, THE OWNER'S MANUAL DOES NOT SPECIFY ANY RECOMMENDED MAINTENANCE FOR THE SHIFT INTERLOCK.
