BRAKE PEDAL GOES TO FLOOR MAKING STOPPING DIFFICULT
MY WIFE REAR ENDED SOMEONE. SHE WAS UNABLE TO STOP. LUCKILY NOBODY WAS SERIOUSLY INJURED. WE HAVE BEEN COMPLAINING ABOUT THE BRAKES TO FORD FOR TWO YEARS. ABOUT 6 MONTHS AGO FORD FINALLY ACKNOWLEDGED THE ISSUE WHICH IS BELOW. THE MECHANIC AT FORD IN PETALUMA, CA SAID OUR CAR WAS UNSAFE TO DRIVE BUT THEY ARE STILLLLLLLLLLLL WAITING ON PARTS. IT WAS PROMISED 1ST QTR OF 2020 BUT THAT HAS PASSED. I AM CONFIDENT THE ACCIDENT WOULD NOT HAVE TAKEN PLACE IF THE BRAKES WORKED AS THEY SHOULD. "SAFETY RISK THIS MAY RESULT IN EXTENDED BRAKE PEDAL TRAVEL REQUIRED TO STOP THE VEHICLE, INCREASING THE RISK OF A CRASH. THE CONDITION DOES NOT RESULT IN A LOSS OF BRAKING FUNCTION AND THE VEHICLE CAN BE BROUGHT TO A CONTROLLED STOP. *TR
ON DECEMBER 27TH 2019. MY DAUGHTER SLIDE INTO THE BACK OF ANOTHER CAR AND SHE COMPLAINED THE BREAKS WERE TAKING TO LONG TO COME TO A COMPLETE STOP. THE CAR WAS TOTALED AND ON JANUARY 23RD, 2020 WE RECEIVED SAFETY RECALL NOTICE 19S54/NHTSA RECALL 19V-904. HAD WE RECEIVED THIS NOTICE BEFORE 12/27/19 WE BELIEVE REPAIRS WOULD HAVE PREVENTED THE ACCIDENT AND THE CAR WOULD NOT HAVE BEEN SOLD FOR PARTS.

THE CONTACT STATED THAT THE MANUFACTURER EXCEEDED A REASONABLE AMOUNT OF TIME FOR THE RECALL REPAIR. SEPTEMBER 8 WE HAD A CAR ACCIDENT AND OUR CAR WAS TOTALED THE AIR BAGS NONE OF THEM EVER WENT OFF, EVEN THE POLICE AND PARAMEDIC WERE CONCERNED, AND BEING A NURSE I AM VERY CONCERNED, WE WERE GETTING OFF BYPASS AND ANOTHER CAR HIT US. WE WERE REAR ENDED

THE MANUFACTURER WAS NOT NOTIFIED OF THE FAILURE. PRIOR TO THE COLLISION, THE CONTACT RECEIVED NOTIFICATION OF NHTSA CAMPAIGN NUMBER: 16V384000 (AIR BAGS). THE PARTS TO DO THE REPAIR WERE UNAVAILABLE. THE CONTACT STATED THAT THE MANUFACTURER EXCEEDED A REASONABLE AMOUNT OF TIME FOR THE RECALL REPAIR. THE DEALER (MARK MARTIN FORD, 1601 BATESVILLE BLVD, BATESVILLE, AR 72501 (800) 566-4461) WAS CONTACTED AND CONFIRMED THAT THE PARTS WERE NOT AVAILABLE FOR THE RECALL REMEDY. I PURCHASED A SET OF 4 NITTO MOTIVO TIRES SIZE 225/45ZR18XL WITH THE TOP RATING (Y) WITH A 60,000 MILE WARRANTY, DOT # 73J7 L6K4213 ON MARCH 12, 2014 AT DISCOUNT TIRE FOR MY 2008 FORD FUSION. MY VEHICLE AT THE TIME HAD 91,602 MILES ON IT AND TODAY HAS JUST OVER 107,000 MILES. MY VEHICLE WAS TRAVELING THROUGH TOWN WITH A SPEED LIMIT OF 30 AND HEARD A LOUD POP NOISE. THE SIDE WALL OF THE FRONT DRIVER SIDE TIRE BLEW OUT CAUSING MY VEHICLE TO SUDDENLY PULL TO THE LEFT INTO ONCOMING TRAFFIC, LOST CONTROL, AND SMASHED INTO THE DRIVER SIDE FENDER AND PUSHED THE VEHICLE INTO A CURB THUS TOTALING MY CAR AND PROBABLY THE OTHER VEHICLE AS WELL AT NOON TODAY JULY 30, 2014. THE POLICE REPORT REFLECTS MECHANICAL FAILURE AS THE CAUSE OF THE ACCIDENT AND I HAVE WITNESS STATEMENTS FROM A COUPLE THAT WERE TRAVELING BEHIND MY VEHICLE THAT THEY, TOO, HEARD A LOUD POP JUST PRIOR TO THE ACCIDENT. I CONTACTED DISCOUNT TIRE AND WAS TOLD TO BRING IN THE WHEEL, TIRE, AND PICTURES AND THEY WOULD FORWARD MY INFORMATION TO NITTO SO THAT THEY CAN START A CLAIM. NITTO DID NOT ANSWER THEREFORE I WAS GIVEN THE PHONE NUMBER AND I WILL TRY TO CONTACT THEM TOMORROW. I WOULD LIKE TO KNOW WHAT MY CONSUMER RIGHTS ARE AS FAR AS GETTING THE COST OF MY VEHICLE, THE OTHER VEHICLE, MEDICAL BILLS, TOWING COSTS, AND TIME LOSS AND SUFFERING PAID. THE MANUFACTURER WAS NOT NOTIFIED OF THE DEFECT. THE APPROXIMATE FAILURE MILEAGE WAS 73,000. THE VIN WAS NOT AVAILABLE.

ON JUNE 17, 2011 MY DAUGHTER WAS DRIVING MY CAR AND I WAS THE PASSENGER, WE HAD STOPPED AT A FOUR WAY STOP. WHEN WE HAD THE RIGHT AWAY WE PROCEEDED ACROSS THE INTERSECTION. WE WERE STRUCK IN THE INTERSECTION BY A DRIVER WHO RAN THE STOP SIGN. SHE WAS TRAVELING AROUND 30 TO 35MPH AND STRUCK THE PASSENGER SIDE OF MY CAR, SMASHING IN THE FRONT PASSENGER SIDE DOOR, ALSO THE FRONT SUPPORT WHERE THE WINDOW SHIELD IS ATTACHED. ALSO THE MIDDLE SUPPORT WHERE THE FRONT AND BACK DOORS ATTACHED, ALONG WITH THE TOP AND BOTTOM SUPPORTS OF THE VEHICLE. THE DOOR HAD TO BE CUT OFF THE VEHICLE TO REMOVE ME OUT OF IT. THE VEHICLE WAS DEEMED A TOTAL LOSS. MY CONCERN IS THAT THE SIDE CURTAIN AIR BAGS DID NOT DEPLOY IN A CRASH OF THIS NATURE. WHY EVEN HAVE THEM IF THEY DO NOT WORK.
I WAS DRIVING OUR 2008 FUSION ON WINDING ROADS NEAR OUR HOME IN WNC. I WAS INTO A SWITCH BACK TURN AND WAS APPROACHED BY AN ONCOMING VEHICLE WHICH WAS ON MY SIDE OF THE DOUBLE YELLOW LINE. I DID NOT HAVE TO SWERVE BUT ALLOWED PLENTY OF ROOM FOR THE OTHER VEHICLE TO PASS. AS THEY PASSED I WAS PULLED INTO THE SNOW AND ICE AND OFF THE ROAD. I HIT THE SIDE OF A MOUNTAIN AND CAME TO AN INSTANT STOP. OUR VEHICLE HAS SUSTAINED MANY THOUSANDS OF DOLLARS WORTH OF DAMAGE IE FRONT END BUMPER AND SHEET METAL ENGINE CRADLE BROKEN, FRAME FLOOR ROOF BUCKLED DOORS ON THE RIGHT SIDE WINDSHIELD. ALL THIS DAMAGE WITH NO AIR BAG DEPLOYMENT OR SEAT BELT INTERLOCK! I WAS DRIVING APPROXIMATELY 30 TO 35 MPH AND SUSTAINED SEVERAL INJURIES AMONG WHICH ARE; FACIAL LACERATIONS AND CONTUSIONS, KNEE INJURY RESULTING IN BRUISING AND CONTUSIONS AND REINJURING OF RECENT SHOULDER SURGERY. I WAS DRIVING HOME FROM WORK ON RT. 511OR LORAIN STREET IN OBERLIN, OHIO. THE LIGHT ON LORAIN AND S. PLEASANT WAS FLASHING. I HAD THE YELLOW FLASHING LIGHT I WAS DRIVING 35 THE SPEED LIMIT AND A GIRL WITH HER TWO CHILDREN DID NOT STOP FOR HER RED LIGHT AND I HIT HER T-BONE. MY AIRBAGS DID NOT DEPLOY AND MY SEATBELT DID NOT LOCK. THIS FORCED ME TO GRIP THE STEERING WHEEL WITH MY HANDS AND AS I DID THIS I BRUISED MY ARMS, CHEST FROM THE STEERING WHEEL TRAUMA. I RAISED UP FROM THE SEAT AND HIT THE TOP OF MY KNEES AND THEY ARE BRUISED. I WAS TAKEN BY AMBULANCE TO THE NEAREST HOSPITAL FOR TREATMENT AND RELEASE. I MISSED 3 DAYS OF WORK AND STILL HAVE PAIN IN MY MUSCLES AND TRAUMA TO MY BODY. I HAVE CONTACTED FORD MOTOR CO. FOR THEIR RESPONSE. I FEEL I SHOULD BE COMPENSATED DUE TO MY INJURIES AND MISSING WORK. AND IF I HAD BEEN DRIVING ON A HIGHWAY AND THIS HAPPENED I COULD HAVE BEEN HURT WORSE OR THROWN THROUGH THE WINDSHIELD. My Breaks gave way for some odd reason I ran into a cable box trying to control or rather stop the vehicle.
The contact owns a 2008 Ford Fusion. The contact stated that while driving approximately 30 mph the brakes failed and the pedal extended to the floor causing the vehicle to crash into a stationary truck. During the crash, the front end was damaged but the airbags did not deploy. No injuries were reported, no police report was taken and the vehicle was not towed. The cause of the failure was not determined. The manufacturer and local dealer were notified of the failure but no assistance was offered. The contact was notified that the vehicle was included in the NHTSA campaign number 19v904000(service brakes) and 21v158000(airbags) however, the parts to do the recall repairs were unavailable.The contact indicated that the vehicle had experienced the same failure listed in the recall and the manufacturer had exceeded a reasonable amount of time for the recall repair. The failure mileage was 169,000.

THE CONTACT WAS INFORMED THAT THE VEHICLE WAS INCLUDED IN THE NHTSA CAMPAIGN NUMBER 19V904000(BRAKING SYSTEM ) BUT THE PARTS TO REMEDY THE DEFECT WERE NOT AVAILABLE.
