MY DAUGHTER WAS ABOUT A MILE FROM HOME AFTER TAKING A FRIEND HOME. IT WAS AUGUST 27, 2012 AROUND 9:30PM. HER CAR WENT OFF THE ROAD CRASHED INTO A TREE AND CAUGHT FIRE. SHE WAS KILLED IN THE ACCIDENT. WHAT IS PUZZLING IS THERE WERE NO SKID MARKS, NO SIGNS OF BRAKING. IT HAS BEEN BROUGHT TO OUR ATTENTION JUST YESTERDAY THAT THERE WAS A RECALL ON HER AUTOMOBILE THAT WE WERE NEVER AWARE OF. WE WERE TOLD THAT IF THERE WAS A THROTTLE PROBLEM THEN THAT WOULD MAYBE EXPLAIN THE ABSENT SKID MARKS AND NO SIGNS OF BRAKING. SHE WAS ONLY 19 YEARS OLD. WHILE DRIVING HOME FROM HAVING A FEW DRINKS WITH MY FRIENDS, A DEER RAN OUT IN FRONT OF ME AND ALTHOUGH I SLAMMED ON THE BRAKES, I COULDN'T STOP QUICK ENOUGH TO AVOID HITTING THE DEER AND SMASHING IN THE GRILL OF MY NEW CAR. WHEN THE STATE PATROL ARRIVED, THEY GAVE ME A TICKET FOR SPEEDING AND AFTER I TOLD THEM THAT I WAS NOT SPEEDING WHEN I HIT THE DEER, (I HAD GOTTEN THE SPEED DOWN TO ABOUT 60MPH AT IMPACT) THEY THEN WANTED ME TO TAKE A ALCOHOL IMPAIRED TEST WHICH I NATURALLY DECLINED BECAUSE I WASN'T IMPAIRED. I ONLY HAD JUST A FEW DRINKS AND MAYBE SOME BEER & WINE AT DINNER AND MAYBE 2 DRINKS BEFORE I LEFT TO GO HOME. THEY THEN PROCEEDED TO ARREST ME LIKE A COMMON CROOK AND TOOK ME TO JAIL, WHERE I HAD TO SPEND THE NIGHT. ANYWAYS, MY INSURANCE COMPANY REFUSES TO FIX MY NEW CAR AND NOW THE CAR COMPANY REFUSES TO FIX IT ALSO. THIS CAR IS A PIECE OF JUNK. IF IT HAD BEEN MADE GOOD, IT WOULDN'T HAVE SUSTAINED ALL THAT DAMAGE FROM HITTING A LOUSY DEER. WHILE TRYING TO FIX THE DAMAGE MYSELF, MY FRIEND [XXX] PUT SOME GAS ON THE GRILL AND LIT IT TO SOFTEN UP THE PLASTIC JUNK THEY MADE THE GRILL OUT OF, SO WE COULD BEND IT BACK TOGETHER AND J.B. WELD IT. WELL, [XXX] GOT SOME OF THE HOT MELTED PLASTIC ON HIM AND IT BURNED LIKE [XXX] AND HE JUMPED UP AND KNOCKED OVER THE JAR WITH GAS IN IT AND THE WHOLE PLACE WENT UP IN FLAMES. MY CAR NOT ONLY BURNED, BUT MY GARAGE WENT UP IN SMOKE TOO. NOW THE INSURANCE COMPANY IS TELLING ME THAT THEY WON'T PAY THE CLAIM FOR THE GARAGE OR THE CAR CAUSE IT LOOKS LIKE ARSON FOR PROFIT. A POLICE REPORT WAS NOT FILED. THE DRIVER SUSTAINED BRUISING TO THE LEGS AND WAS UNCONSCIOUS. MEDICAL TREATMENT WAS RECEIVED. THE MANUFACTURER ISSUED NHTSA CAMPAIGN NUMBER: 12V353000 (ENGINE AND ENGINE COOLING, VEHICLE SPEED CONTROL); HOWEVER, THE VEHICLE WAS NOT INCLUDED. THE MANUFACTURER WAS NOTIFIED OF THE FAILURE AND INQUIRED ABOUT ACCESS TO THE VEHICLE TO INVESTIGATE THE CAUSE OF THE FAILURES. THE APPROXIMATE FAILURE MILEAGE WAS 177,000.
WAS DRIVING 25 MILES AN HOUR DOWN SMALL HILL, THE CAR IN FRONT OF ME STOPPED. I HIT THE BRAKES AND THE CAR DIDN'T STOP IT FELT AS IF I WAS PUSHING THE ACCELERATOR LIKE WHEN PUSHING BUTTON! TO SPEED UP CRUISE CONTROL AND IT SLOWLY INCREASES SPEED. I SLAMMED BOTH FEET TO THE BRAKE AND WENT TO REACH FOR EMERGENCY BRAKE BUT NEVER MADE IT. I HIT THE OTHER CAR. LAST THING I REMEMBER IS HEARING METAL CRUNCH, THE NEXT THING I REMEMBER IS SMOKE, TOP OF MY HEAD ON LEFT SIDE HAIRLINE ACHED LOOKED IN MIRROR AND SAW BLOOD. STARTED LOOKING FOR MY PHONE ON THE DASH BUT IT WAS BROKEN.COULD HEAR SOMEONE TALKING, THEN PEOPLE WERE WALKING UP TO CAR. WHEN THE OFFICER GOT THERE HE ASKED WHAT I HIT MY HEAD ON I DIDN'T KNOW, HE ASKED IF I HAD MY SEATBELT ON I SAID YES. I TOLD HIM MY CAR WOULDN'T STOP. REALIZED WHEN E.M.T ASKED SAME QUESTION I KNEE I HAD IT ON BUT COULDN'T REMEMBER TAKING IT OFF, AND I TOLD HIM THAT. HE LOOKED AT CHEST DIDN'T SEE MARKS OR BRUISING, HE ASKED AGAIN IF I WAS SURE, I WAS SURE I PUT IT ON. AFTER CRASH, WHEN GOT TO TOW YARD NEXT DAY SAW MY SEAT BELT BROKE, I CRACKED THE WINDSHIELD WITH MY HEAD AND BROKE ALL UNDER STEERING WHEEL WITH MY KNEES...BUT THE AIRBAGS DEPLOYED MUST HAVE BEEN AFTER I HIT EVERYTHING BECAUSE IT HIT ME IN THE ARM ONLY BASED ON THAT STINGING RED RAISED RASH THAT LATER BRUISED ON MY FOREARM, NO AIRBAG TO FACE INJURIES, JUST HIT TOP OF HEAD ON WINDSHIELD AND KNEES ON LOWER DASH UNDER STEERING WHEEL, BRUISING ON STOMACH LOWER ABDOMEN NEAR PELVIC BONE MAY HAVE BEEN STEERING WHEEL. MY CAR KEPT GOING FASTER BRAKES DIDN'T SLOW ME AT ALL WITNESS SAID AND MY SEATBELT LATCH IS IN PIECES, MY AIRBAG WENT OF LATE. THE CONTACT DEPRESSED THE BRAKES BUT THE VEHICLE WOULD NOT DECELERATE. ON AUGUST 8, 2007, THE CONTACT WAS INVOLVED IN A CRASH THAT WAS RELATED TO A PREVIOUS RECALL REPAIR FOR THE VEHICLE SPEED CONTROL (NHTSA CAMPAIGN NUMBER 04V574000). A POLICE REPORT WAS FILED. THE FAILURE MILEAGE WAS 60,000 AND CURRENT MILEAGE WAS 66,000.
