A 200 LB 80 YEAR OLD MAN WAS SITTING IN THE PASSENGER SEAT OF HIS VAN. WHEN HE AND HIS WIFE WAS REAR-ENDED IN A 25-30 MPH IMPACT BY A 85 NISSAN PICKUP. THE IMPACT CAUSED THE PASSENGER SEAT TO FALL BACKWARDS AND THE MAN BROKE HIS NECK, HE PASSED AWAY A FEW DAYS LATER. SEEING HOW THIS IS A FAIRLY NEW VEHICLE, IT DOES NOT SEEM RIGHT THAT THE SEAT BROKE UNDER SUCH A RELATIVELY MINOR IMPACT. WHO WOULD I NEED TO CONTACT TO INITIATE A MANUFACTURING DEFECT CLAIM TO HELP COVER THE MOUNTAIN OF MEDICAL BILLS RESULTING FROM THIS A INCIDENT?

TL* THE CONTACT OWNED A 1998 DODGE GRAND CARAVAN. WHILE THE CONTACT'S WIFE WAS DRIVING 45 MPH, ANOTHER VEHICLE TRAVELING APPROXIMATELY 70 MPH STRUCK THE REAR OF THE CONTACT'S VEHICLE. THE AIR BAGS DID NOT DEPLOY. THE FRONT PASSENGER SEAT (THE CONTACT'S SEAT) SEPARATED FROM THE SEAT TRACK. THE CONTACT STRUCK THE SIDE DOOR AND WAS THROWN INTO THE REAR OF THE VEHICLE. THE SEAT BELT FAILED TO RESTRAIN THE CONTACT AND HE WAS THEN STRUCK BY THE SEAT. THE CONTACT SUSTAINED INJURIES TO THE NECK AND BACK. THREE OCCUPANTS IN THE OTHER VEHICLE WERE ALSO INJURED, AS THE FRONT PASSENGER'S FEET WENT THROUGH THE WINDSHIELD AND TWO OF THE OCCUPANTS SUFFERED WHIPLASH. MEDICAL ATTENTION WAS REQUIRED FOR ALL THE INJURED OCCUPANTS. A POLICE REPORT WAS FILED. THE VEHICLE WAS TOWED FROM THE SCENE AND THE CONTACT'S INSURANCE COMPANY CONFIRMED THAT THE VEHICLE WAS DESTROYED. THE MANUFACTURER AND DEALER WERE NOT MADE AWARE OF THE FAILURE. WHILE ENTERING THE VEHICLE MY 3 YEAR OLD DAUGHTER SLIPED INTO THE FRONT DRIVERS SEAT, I HAD OPENED THE SIDE DOOR TO PUT HER IN HER CAR SEAT AND IN A MATTER OF SECONDS SHE SLIPPED INTO THE OPENED FRONT DOOR WHERE I HAD JUST TURNED ON THE AC TO COOL THE VEHICLE OFF. WHEN I WENT TO TAKE HER OUT OF THE SEAT SHE GRADED THE GEAR SHIFT AND WITH ME HOLDING ONTO HER AND THE STEERING WHEEL I WAS DRAGGED BY THE MOVING VEHICLE UNTIL WE RESTED UPON THE FENCE THAT SURROUNDS MY SIDE/REAR YARD. SHE WAS NOT INJURED BUT I STRAINED MY BACK BUT DID NOT RECEIVE MEDICAL ATTENTION. I WAS UNAWARE OF THE ABILITY OF THE VEHICLE TO MOVE SO EASILY AND WAS WITHIN ARMS REACH THE ENTIRE TIME. I HAVE REPORTED THE INCIDENT TO THE INSURANCE COMPANY BUT NO POLICE WERE INVOLVED.
